1. Acceptance of Terms
By accessing or using Quord (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.
Quord reserves the right to update these Terms at any time. Continued use after changes constitutes acceptance of the updated Terms.
2. Description of Service
Quord is a sports facility booking and management platform that enables:
- Players to discover and book sports facilities
- Facility owners to manage bookings, memberships, and payments
- Members to manage their memberships and booking history
3. User Accounts
To use the Platform, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Keep your login credentials confidential
- Be responsible for all activity under your account
- Notify us immediately of any unauthorised access
You must be at least 13 years old to create an account. Quord may suspend or terminate accounts that violate these Terms.
4. Bookings
When you make a booking through the Platform:
- You agree to the facility's booking rules, including cancellation policies
- Bookings are subject to availability and may be cancelled by the facility
- Cancellation deadlines are set by each facility and enforced by the Platform
- No-shows may be tracked and may affect your ability to make future bookings
5. Memberships
Membership terms are defined by each facility. By joining a facility as a member, you agree to:
- The membership type's terms, including duration and renewal conditions
- Share your profile information with facility managers (see our Privacy Policy)
- Pay any applicable membership fees according to your chosen payment option
Memberships may auto-renew unless you disable auto-renewal or cancel before the renewal date.
6. Payments
Payments on the Platform are processed securely through Stripe. By making a payment, you agree that:
- All fees are stated in the currency displayed at the time of purchase
- You authorise the charge to your payment method
- Refund policies are determined by each facility and subject to applicable law
- Quord does not store your payment card details
7. Facility Owners
If you register as a facility owner or manager, you additionally agree to:
- Provide accurate facility information (address, hours, amenities)
- Honour confirmed bookings except in cases of force majeure
- Handle member data in compliance with applicable data protection laws
- Maintain a valid Stripe account for payment processing
- Pay the applicable subscription fees for your chosen plan
8. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose
- Interfere with or disrupt the Platform's operation
- Attempt to gain unauthorised access to any part of the Platform
- Create multiple accounts to circumvent restrictions
- Scrape, crawl, or otherwise extract data from the Platform without permission
- Impersonate another person or misrepresent your affiliation
9. Intellectual Property
All content, trademarks, and software associated with Quord are owned by or licensed to Quord. You may not copy, modify, distribute, or create derivative works from any part of the Platform without prior written consent.
10. Limitation of Liability
To the maximum extent permitted by law:
- Quord provides the Platform "as is" without warranties of any kind
- Quord is not liable for any indirect, incidental, or consequential damages
- Quord is not responsible for actions or omissions of facility owners, managers, or other users
- Quord's total liability shall not exceed the amount you paid to Quord in the 12 months preceding the claim
11. Indemnification
You agree to indemnify and hold Quord harmless from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.
12. Termination
You may close your account at any time. Quord may suspend or terminate your access if you violate these Terms. Upon termination:
- Your right to use the Platform ceases immediately
- Any outstanding bookings may be cancelled
- Data retention is governed by our Privacy Policy
13. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
